1. Who we are and how to contact us
Wellzapp is the public identity of the service. Its main operations are in the United States, in the state of Florida. The official channel for initial assistance, privacy, security, cancellation, refunds and formal communications is contato@wellzapp.com. We aim to reply within 1 business day.
2. Acceptance and eligibility
By creating an account, subscribing to a plan or using Wellzapp, you agree to these Terms and the Privacy Policy. If you are acting on behalf of an organization, you declare that you are authorized to represent it. If you do not agree, do not use the service.
3. The service and channel risks
Wellzapp helps organize leads, contacts, pipelines, conversations, templates, schedules, devices and campaigns. The availability of each feature and its limits depend on the plan and the rollout stage indicated on the platform.
The current integration uses WhatsApp Web and is not an official WhatsApp integration. Use may be affected by disconnections, restrictions, blocks or changes imposed by the channel. We do not promise continuous connection, delivery of all messages, freedom from blocks or commercial results.
4. Your responsibility for contacts and messages
- You decide which contacts, lists, groups, messages and media you use on the platform and are responsible for the legitimacy of that use.
- You must respect consents, unsubscribe requests, channel rules and the laws applicable to your audience and operations.
- Do not use Wellzapp for spam, fraud, harassment, illegal content, hate speech, infringement of rights or any abuse.
5. Data and privacy
You retain the rights you hold over data entered into the platform. You authorize Wellzapp to process that data to the extent necessary to provide, protect and improve the service, in accordance with the Privacy Policy. You must not enter data you do not have the right to use.
6. Security and account access
We adopt reasonable technical and administrative controls, such as authentication, password hashing, account separation, access controls and MFA when available. No system is completely secure. You must protect your credentials, keep your access details up to date and notify us immediately through the official email address if you suspect misuse.
7. Plans, initial offer and limits
For monthly plans, the public launch offer grants eligible new customers a 30% discount on the first month, as presented before subscription. From the second month onward, the normal monthly price applies. The monthly offer does not apply to and cannot be combined with annual plans. For annual plans, the discount indicated at subscription applies and the total amount is charged once a year. Public plans offer 2, 4 or 6 devices, subject to the features and limits presented on the platform.
8. Billing, cancellation and refunds
There is no free trial. Paid plans are billed on a recurring monthly or annual basis, according to the option subscribed to. You may request cancellation at any time by emailing contato@wellzapp.com. Unless the law requires otherwise, cancellation prevents the next renewal and access continues until the end of the period already paid for.
You may request a refund within 7 calendar days of the first charge under your first contract. This contractual refund policy does not apply to renewals. It also does not reduce or eliminate mandatory consumer rights provided by applicable law.
9. Suspension and termination
We may limit, suspend or terminate access in the event of a breach of these Terms, a security risk, abuse, a legal obligation or nonpayment. When reasonable and permitted, we will try to give notice and an opportunity to remedy the issue.
10. Intellectual property
Wellzapp, its interface, brand, documentation and software are protected by applicable laws. These Terms grant you a limited, revocable and nontransferable right to use the service for the duration of the plan. They do not transfer ownership of the service or brand.
11. Limits of liability
To the extent permitted by applicable law, the service is provided as is and may be subject to interruptions. Wellzapp is not liable for decisions by WhatsApp or Meta, customer conduct, lost opportunities, lost profits or indirect damages. Nothing in this section excludes liability or rights that cannot be limited by law.
12. Applicable law, changes and contact
Wellzapp operates primarily from Florida, United States. To the extent permitted by applicable law, these Terms are governed by the laws of Florida and the United States. Mandatory consumer protection and privacy rules where you reside continue to apply when applicable.
We may update these Terms to reflect changes in the service, operations or legislation. When a change requires renewed acceptance, we will present the updated version before continued use. Questions and formal communications must be sent to contato@wellzapp.com.
